Preamble & Mandatory Legal Agreement

This document constitutes a legally binding electronic contract between you, whether personally or on behalf of an individual (“User”, “Member”, “Data Principal”), and the Jain Vadhu Var Parichay Sanstha, Pune (“Sanstha”, “Samaj”, “Trust”, “We”, “Us”, “Our”). This agreement governs your access to and utilization of the Jain Vadhu Var Parichay Sanstha, Pune Platform, its digital directory, sub-caste indexing services, and related community publications.

This Terms of Use is an electronic record in accordance with the Information Technology Act, 2000, and the rules framed thereunder, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. This electronic record is generated by a computer system and does not require any physical, electronic, or digital signatures to establish its absolute enforceability and binding nature.

By clicking “I Agree,” “I Accept,” or by registering, accessing, browsing, or making a payment on this Platform, you explicitly acknowledge that you have read, understood, and unconditionally agreed to be bound by every single clause, condition, and limitation of liability contained in these Terms of Use, as well as our accompanying Privacy Policy. If you do not agree with these practices or object to any specific provision within this document, you must immediately cease accessing the Platform and refrain from submitting any registration details or fees.

1. Statutory Eligibility, Capacity, and Community Boundaries

1.1. Legal Marriageable Age: The utilization of this Platform is strictly restricted to individuals who have attained the legal age of marriage under the laws of the Republic of India. At the time of registration, male candidates must be at least twenty-one (21) years of age, and female candidates must be at least eighteen (18) years of age. The Sanstha does not knowingly collect data from or host profiles of minors or individuals below the legal matrimonial threshold.

1.2. Current Marital Status: You explicitly warrant and represent that you are legally competent to enter into a valid matrimonial alliance under the Hindu Marriage Act, 1955, or any other applicable personal/special laws of India. You must be either a bachelor, legally divorced by a final decree of a competent court of law, or widowed. If you are currently separated, or if divorce proceedings are pending before any judicial forum, you are strictly prohibited from utilizing this Platform.

1.3. Community and Sub-Caste Specificity: This Platform is exclusively created for the socio-cultural welfare of the Jain Samaj. Membership and listing privileges are strictly restricted to individuals belonging to this specific community. You are required to accurately specify your sub-caste during registration. Any attempt to infiltrate the database by individuals outside the designated community constitutes a material breach of contract and fraud.

1.4. Mental Competence: You declare that you are of sound mind, possess the full legal capacity to execute contracts, and are not barred by any statutory law or court mandate from entering into a marital alliance or executing binding electronic agreements.

2. Account Structuring, Security, and User Verification

2.1. Absolute Individual Account Model: The Platform operates on a strict single-user individual account architecture. The creation of joint accounts or proxy accounts is completely prohibited. The candidate whose matrimonial profile is being displayed must remain the primary custodian of the account. The Sanstha does not offer linked or concurrent family account dashboards; any access by parents, guardians, or siblings must be done via the primary user's credentials with the explicit authorization of the candidate.

2.2. Declarations of Absolute Truth: By submitting the matrimonial registration form, you solemnly declare and affirm that all information, documents, text, metrics, income details, and professional declarations provided by you are entirely true, complete, and accurate to the best of your knowledge. You acknowledge that providing forged documents, falsified educational degrees, fabricated income certificates, or deceptive profile descriptions will result in immediate profile termination without notice, loss of fees, and potential civil or criminal escalation by aggrieved users or the Sanstha.

2.3. Account Security and Integrity: You are solely responsible for maintaining the confidentiality of your login credentials (username, password, OTP routing) generated during the registration wizard. You agree to accept full responsibility for all activities, searches, filters, and communication exchanges that occur under your account. You must immediately notify the Committee if you suspect any unauthorized access or breach of security regarding your profile.

3. Scope of Service: Purely Facilitative Search Directory

3.1. Definition as a Directory Facilitator: You explicitly acknowledge and understand that the Jain Vadhu Var Parichay Sanstha, Pune, acts strictly as a technological and community facilitator. The Platform is operationally defined as an indexed, digital directory of self-declared matrimonial candidates. The Sanstha provides the platform to help eligible users discover other candidates within the community, but does not actively manage, arrange, or dictate marriages or interpersonal relationships.

3.2. Total Absence of Automated Profiling or Matching Algorithms: The Platform does not utilize automated algorithms, artificial intelligence matching engines, compatibility scoring models, or recommendation routines to push specific profiles to you. The system operates as a self-serve query engine infrastructure. All registered and verified users can view all other registered and verified users within the directory. Profile discovery is entirely controlled by you through the manual application of basic and advanced search filters, including age, height, education, profession, income, and sub-caste.

3.3. Complete Absence of In-App Communication Systems: To maximize privacy, this Platform does not provide real-time chat, in-app messaging, voice calling, or video calling functionalities. Users cannot text or exchange digital messages directly within the system. Direct contact sharing is strictly gated. Communication between parties must happen completely off-platform via independent phone calls or personal meetings, which can only occur after mutual interest is established and consent is given to exchange contact details.

4. Mandatory Registration Fee & No-Refund Policy

4.1. Paid Access Only: Access to the platform's searchable directory, filter functionalities, and candidate profiles is strictly restricted to paid members. The Platform operates on a single-tier, paid-access-only model. There are no free trials, basic free tiers, or dynamic subscription plans. The mandatory fee must be paid in full at the time of registration through the registration wizard.

4.2. Payment Gateway Processing: All financial transactions are executed, processed, and reconciled through an integrated, secure, RBI-compliant third-party payment gateway (Razorpay). The Sanstha does not capture, harvest, or store raw credit card numbers, debit card numbers, net banking credentials, or UPI PINs on its Hostinger VPS servers. The Sanstha is not responsible for any payment failures, bank declines, or fraudulent card activities occurring within the third-party gateway's interface.

4.3. Absolute and Irrevocable No-Refund Policy: Once the registration fee is paid and submitted along with your profile form, the fee is 100% non-refundable under any condition or circumstance. This strict no-refund rule applies universally and without exception, regardless of such “included but not limited to” circumstances:

5. The Internal Review System & Melawa Book Publication

5.1. Role and Mandate of Samaj Reviewers: You acknowledge that your profile will not be instantly visible to the general directory upon the completion of payment. The Sanstha deploys an administrative workflow wherein designated Reviewers of the Samaj review your submitted government identity proofs, certificates, and photographs. These Reviewers verify basic community eligibility and check for clear platform abuse. The Reviewers hold the absolute authority to reject, pause, or request corrections to any profile that does not meet the cultural or structural guidelines of the Sanstha.

5.2. Absolute Consent for Multi-Channel Community Publication: By submitting your matrimonial registration form, you provide your explicit, irrevocable, and unconditional consent to the Sanstha to compile, format, and publish your self-declared personal data, sub-caste, background details, and photograph/s across the following channels:

5.3. Purpose Limitation: The publication of this data is executed strictly for the sole purpose of matrimonial introductions within the community. You acknowledge that once your data is printed in the physical Melawa Book and distributed to families during community events, the Sanstha cannot recall, erase, or delete those physical copies, even if you subsequently request profile erasure from the digital platform.

6. User Code of Conduct & Strictly Prohibited Activities

You agree to use the Platform strictly for bona fide, matrimonial matchmaking purposes. Any deviation from this purpose constitutes a material breach of this agreement. You are strictly prohibited from engaging in the following activities:

6.1. Commercial Solicitation: Using the directory, user data, phone numbers, or email addresses to promote commercial businesses, sell financial products, solicit insurance policies, recruit for jobs, or run multi-level marketing (MLM) schemes.

6.2. Data Scraping and Extraction: Using automated scripts, web scrapers, bots, spiders, indexing tools, or manual mass-copying methods to extract candidate details, phone numbers, addresses, or photos from the Platform's database.

6.3. Content Misuse: Downloading, copying, taking screenshots, or redistributing other users' photographs or video introductions outside the platform or on public social media platforms.

6.4. Unlawful Content Submission: Uploading, posting, or transmitting any material that is defamatory, obscene, pornographic, blasphemous, ethnically objectionable, or legally prohibited under the Information Technology Act, 2000, or the Bharatiya Nyaya Sanhita (BNS).

6.5. Harassment and Abuse: Harassing, stalking, threatening, defaming, extorting, or blackmailing any other user whose details you obtained via the digital platform or the printed Melawa Book.

7. Intermediary Status & Exclusion of Warranties

7.1. Intermediary Safe Harbor Declaration: You explicitly understand and agree that the Jain Vadhu Var Parichay Sanstha, Pune operates strictly as an “Intermediary” as defined under Section 2(1)(w) of the Information Technology Act, 2000. In accordance with Section 79 of the Information Technology Act, 2000, the Sanstha is afforded absolute statutory immunity (“Safe Harbor”) from civil or criminal liability regarding any user-generated content, profile information, text, media, documents, or claims uploaded to the platform by its members. The Sanstha does not initiate the transmission, select the receiver of the transmission, or modify the information contained in the directory listing.

7.2. Disclaimer of Warranties: The Platform, its search indexing system, and all profiles contained therein are provided entirely on an “AS-IS” and “AS-AVAILABLE” basis. The Sanstha, its Trustees, and technical partners make no representations or warranties of any kind, express or implied, including but not limited to:

8. User Due Diligence Mandate

8.1. Principle of Let the User Beware: The legal principle of Caveat Emptor applies to your use of this Platform. You and your family hold the complete, non-transferable obligation to perform deep, exhaustive, and independent background verifications before entering into any personal communication, courtship, engagement, or marriage contract with any individual discovered through this platform.

8.2. Limitation of the Identity Proof Review: You understand that while the Sanstha's Reviewers check submitted identity proofs to maintain platform security, this check is designed only to confirm identity match. The Sanstha does not conduct professional background checks, employment verifications, salary audits, residential inspections, character assessments, or criminal record history checks.

9. Absolute Exclusion of Liability

THIS CLAUSE ABSOLUTELY LIMITS THE LIABILITY OF THE SANSTHA. PLEASE READ CAREFULLY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO LEGAL THEORY (WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) SHALL THE JAIN VADHU VAR PARICHAY SANSTHA, PUNE, ITS TRUSTEES, MANAGING COMMITTEE MEMBERS, DESIGNATED REVIEWERS, VOLUNTEERS, EMPLOYEES, OR TECHNICAL CORE PARTNERS BE LIABLE TO YOU, YOUR FAMILY, OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, LOSSES, OR INJURIES WHATSOEVER.

THE SANSTHA REJECTS ALL CIVIL AND CRIMINAL LIABILITY FOR:

9.1. Identity Theft, Misrepresentation & Fraud: Any catfishing, financial scams, identity theft, or deceptive marital profile creations executed by malicious actors on the Platform.

9.2. Physical, Emotional, or Psychological Harm: Any physical violence, stalking, sexual harassment, emotional distress, defamation, or untoward incidents resulting from offline interactions, telephone calls, or personal meetings arranged between users introduced through the digital platform or the Melawa Book.

9.3. Financial or Property Loss: Any financial losses, property disputes, extortion demands, or dowry claims arising from alliances, engagements, or marriages entered into based on data available on this platform.

9.4. Structural / Technical Failures: Any unauthorized data breaches, ransomware attacks, or leaks from our S3/Spaces storage systems executed by third-party cybercriminals.

10. Legal Indemnification Clause

You agree to unconditionally defend, indemnify, protect, and hold completely harmless the Jain Vadhu Var Parichay Sanstha, Pune, its active Trustees, Managing Committee members, Reviewers, administrative staff, and technical developers from and against any and all claims, civil lawsuits, criminal complaints, liabilities, damages, judgments, losses, demands, costs, or expenses (including reasonable legal fees and court costs) arising directly or indirectly out of:

10.1. Your breach or violation of any clause contained within these Terms of Use or our Privacy Policy.

10.2. Any inaccurate, misleading, fraudulent, or defamatory data submitted by you during registration.

10.3. Your conduct, behaviour, actions, or interactions with other users, whether online, over phone calls, or during in-person meetings.

10.4. Any marital disputes, broken engagements, or subsequent legal litigation occurring between your family and another member's family.

11. Profile Suspension, Termination, and Account Deletion

11.1. Unilateral Termination Rights: The Committee of the Sanstha reserves the absolute right to suspend, freeze, block, or permanently delete your profile from the digital directory as well as from offline book publishing in the following editions, at any time, without prior notice and without a refund, if:

11.2. Voluntary Deactivation & Right to Erasure: You may request the deactivation or permanent deletion of your digital profile at any time by utilizing the self-serve deletion tool within your account dashboard or by contacting the Committee in writing. Upon processing your request, your profile will be purged from the active searchable digital directory. However, you acknowledge that any data or photographs already printed in distributed physical copies of the Melawa Book cannot be modified or recalled.

12. Intellectual Property Rights

12.1. Ownership of Platform IP: All content present on the Platform—including but not limited to web design interfaces, application architecture, logos, graphics, source code, database compilations—is the exclusive intellectual property of the Jain Vadhu Var Parichay Sanstha, Pune.

12.2. Prohibited Exploitation: You are strictly prohibited from copying, modifying, reverse-engineering, reproducing, or commercially exploiting any part of the Platform's layout, brand name, or compilation structures without the explicit, written authorization of the Board of Trustees.

13. Severability and Non-Waiver

13.1. Severability: If any provision, clause, or sub-clause of these Terms of Use is determined to be invalid, illegal, or unenforceable by any court of law or regulatory body, such invalidity shall not affect the remaining provisions of this contract. The remaining terms shall continue to be valid and enforceable to the fullest extent permitted by law.

13.2. Non-Waiver: Any failure or delay by the Sanstha to enforce or exercise any right or provision contained within these Terms shall not be construed as a waiver of our right to enforce that specific provision or any other provision at a later date.

14. Governing Law and Exclusive Jurisdiction

These Terms of Use, the accompanying Privacy Policy, and the entire relationship between you and the Sanstha shall be governed, interpreted, and construed strictly in accordance with the substantive laws of the Republic of India, without regard to any conflict of law principles.

You explicitly agree that any legal action, dispute, lawsuit, claim, or judicial proceeding arising out of or in connection with the Platform, its directory, or its management committee shall be subject to the exclusive jurisdiction of the competent civil courts situated strictly in Pune, Maharashtra, India.

In strict compliance with the Information Technology Rules, 2021, and the Digital Personal Data Protection Act, 2023, if you have any questions, concerns, complaints regarding other users, or grievances regarding your data processing, please contact our designated Grievance Redressal Committee:

The Grievance Redressal Committee may acknowledge your formal complaint within Forty-Eight (48) hours of receipt. The Committee may conduct a review of the matter and endeavour to resolve the dispute, profile block, or data grievance within fifteen (15) working days from the date of the complaint.
